A day after we purchased our home in Macomb early summer of 2011, an elder man from a neighboring house introduced himself as Mr. Jackson, a former construction worker. Mr. Jackson showed us the property corners the same day. About a week later, Mr. Jackson · trespassed into our home and demolished posts installed by construction workers we hired for improvement of our house · attached a rope with a hook on a branch of the tree standing in the right front side of our home. He then claimed that he owned a portion of about 20 feet wide of our property. · he requested that we pay for a survey but then he rejected it, although it matched the existing property corners · In September 1, 2012, he used his 4-weel engine mower to strike my wife who was standing in our property holding our 3-year old son. My wife ended up in the emergency room of the hospital. Doc 32 shows a letter from our attorney to the Jacksons following the violence against my wife and son. · On December 2013, a few days after I fired my first attorney in the case against WIU et al. my wife and I received a letter from the March, McMillan, DeJoode & Duvall & Law office on behalf of the Jacksons (Doc 33) who threatened to sue us by January 30, 2014. · Early spring 2014, Mr. Jackson dogged holes underneath our fences so that he could access our home. As I started covering the holes using wooden planks, Mr. Jackson engaged in calling me names. He said that I was a monkey from Africa; that I have no right to own a home in the USA; and that we should return to Africa to live on trees. Furthermore, he promised to make me regret my entire life for filing a lawsuit against WIU. On September 8, 2014, about 3 months after we moved from Macomb to Eau Claire, Wisconsin, my wife and I received at our home, a summons for a lawsuit (Doc 34) filed against us by the March, McMillan, DeJoode & Duvall & Law Office in Macomb on behalf of the Jacksons.
The summons was issued by the Macomb Courthouse with an order to respond in 30 days. That was about 3 days after the Federal Court in Peoria, Illinois granted me 30 days to find a new lawyer. I find myself in the obligation to find two lawyers in 21 days. In their lawsuit, the Jacksons claimed a portion of our lot and complained that the shadow of the vinyl fences surrounding our home kills the grass in their property. The Jackson’s supposed complaint was filed while our house was on the market for sale. Once again, attorneys in Macomb area refused to represent us and the IMP Insurance Company, the insurance provider for our home refused to assist us claiming that our contract did not cover such a legal matter. Finally, we were directed to an attorney in Galesburg, Illinois, who accepted to first file a motion to dismiss the case and then file a counter lawsuit against the Jackson’s for aggravated battery against my wife, false accusation etc… Curiously, after the attorney we hired has filed a motion for dismissal of the case on our behalf, and while we were preparing to file a counter lawsuit against the Jacksons, the IMP Insurance sent us a letter suggesting that we work with a law office named Stellato and Schwartz from Chicago, but at our cost. We wrote to the IMP Insurance company to refute this suggestion and advised IMP Insurance to ask this strange law office to refrain from taking any action on our behalf. We also refused to sign a representation agreement sent to us by the Stellato and Schwartz Law office. Furthermore, we informed the Macomb Courthouse where the supposed case was filed that we have nothing to do with this law firm. Still the Macomb Courthouse continued sending us court documents produced by the strange law office. The attorney we hired started asking us to use the Stellato and Schawrtz Law office against our will. When my wife and I met with a new attorney in Minnesota to countersue the Jacksons for aggravated battery and false accusation, the Macomb Court House withdrew this bogus of case against us with an unprecedented celerity and claimed that the Jacksons moved for voluntary dismissal. All evidences including correspondences with the offices that dwelt with this strange lawsuit, the court decision, the contradictory information produced by some of the actors involved (See Doc 35) and else indicated that this lawsuit was made up by the same group of individuals who forged my records, attacked me, and illegally terminated my employment as Associate Professor. These groups of individuals comingled to
- associate our home with an ongoing litigation to prevent the sale
- tarnish my reputation and portray me as a bad individual
- drain my family financially and emotionally
- keep me busy with an imaginary legal matter in Macomb to prevent me from finding an attorney for the federal case of employment discrimination, and falsification of my professional records against WIU et al. to exhaust the 30-day deadline given to find a new attorney.
It appears that a member of the law office that brought this imaginary case against us was a faculty member in the Department of Law enforcement at Western Illinois University.
